This policy sets out who owns the creative work shown on this website, what you may and may not do with it, how ownership passes to our clients, and what to do if you believe material on this site infringes your rights.
It is published by Bhozza Nostra (Pty) Ltd, trading as Bhozzanostra Creative Studios, registration number 2017/448513/07.
1. Ownership of this website
All material on bhozzanostra.co.za, including the Bhozzanostra name and logo, text, page layouts, design, illustrations, photographs, video and underlying code, is owned by or licensed to Bhozza Nostra (Pty) Ltd. It is protected under the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993, and by international treaty.
Copyright in all original material on this site is reserved. © Bhozza Nostra (Pty) Ltd, 2017 to date.
2. Portfolio and client work
Our portfolio shows work we have produced for clients. Two different sets of rights apply to it, and it is worth being clear about both.
Client brands and marks. Logos, trade marks, product names and brand assets belonging to our clients remain the property of those clients. They appear on this site solely as examples of work we have completed. Their appearance here does not transfer any right in them to us or to you, and does not imply that those clients endorse any other content on this site.
Our creative output. The design, artwork, photography, layout and presentation we created in producing that work remain our intellectual property, subject to the licence granted to the client described in section 3.
Where a client has asked us not to display their work publicly, we do not. If you are a client and would like work removed from this site, email hello@bhozzanostra.co.za and we will take it down.
3. Ownership of work we produce for clients
This section summarises clause 7 of our Service Level Agreement. Where this summary and the signed agreement differ, the agreement applies.
- All designs, concepts, artwork, code, strategies and source files remain our exclusive property until the client has paid in full.
- On full and final payment, the client receives a non-exclusive, perpetual licence to use the final approved deliverables for their intended business purposes.
- Source files, working artwork and unused concepts are not included in that licence unless this has been agreed separately in writing.
- We reserve the right to display completed work in our portfolio, case studies and marketing material, unless the client has agreed otherwise with us in writing.
- Where an engagement is terminated before full payment, no rights in unpaid or unfinished work pass to the client.
4. What you may do with material on this site
You may view this website, and download or print pages, for your own personal or internal business use in evaluating our services. You may link to any page on this site.
You may not, without our prior written permission:
- reproduce, republish, distribute or commercially exploit any material from this site;
- reuse our designs, artwork or photography in your own work, or in any derivative work;
- use our name, logo or brand assets in a way that suggests association, endorsement or partnership;
- remove or obscure any copyright notice, watermark or attribution;
- scrape, harvest or bulk-download images or content, whether manually or by automated means.
Requests for permission can be sent to hello@bhozzanostra.co.za. We deal with reasonable requests, particularly from press and educational users, and usually ask only for attribution.
5. Material supplied to us
Where a client or other party supplies us with logos, photographs, fonts, copy or other material for use in a project, that party warrants that it owns the material or is licensed to use it, and that our use of it will not infringe anyone else’s rights. We rely on that warranty and are not liable for infringement arising from material supplied to us.
6. Reporting an infringement
If you believe that material published on this website infringes your copyright or trade mark, contact us and we will investigate promptly. Please send the following to hello@bhozzanostra.co.za, marked “Copyright complaint”:
- your name and contact details;
- identification of the work you say has been infringed, with proof of ownership or authority to act;
- the exact page address on this site where the material appears, and a description of the material;
- a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law.
We aim to acknowledge complaints within five business days. Where a complaint is well founded we will remove or replace the material. Where we believe the use is lawful we will say so and give our reasons, so that the matter can be dealt with properly rather than left open.
7. Takedown under the ECT Act
Our hosting provider is a member of a recognised industry representative body for the purposes of Chapter XI of the Electronic Communications and Transactions Act 25 of 2002. Formal takedown notices may also be directed to that body. Sending a notification that you know to be materially false may render you liable for damages under section 77(2) of that Act.
